ASSUMPTION OF RISK, WAIVER OF LIABILITY AND RELEASE

Please carefully read the following terms and conditions relating to your participation in the Funnel Gorgeous In-Person Experience ("Event") which is conducted by Funnel Gorgeous ("Company"). By registering for the Event, you ("Attendee") signify your acceptance of and obligation to these terms and conditions, including any written amendments explicitly set forth by Company. If you have objections to the following Terms and Conditions, you should not register for or attend the Event.

Assumption of Risk:

Attendee acknowledges the Event is a multi day experience that includes social and recreational activities that may involve an element of risk of injury. Company does not own, operate, or control the facilities where the social or recreational activities are conducted. Attendee expressly assume any and all risks, consequences and liability associated with my participation in the Event, including, but not limited to, injury or illness resulting from allergens, food, contact with other participants, your accommodations, participation in Event activities, and transportation to and from the Event and related activities. All such risks are understood and appreciated by the Attendee. Attendee releases, forever discharges and holds harmless Company and its officers and directors, staff, employees, agents and volunteers from all actions, causes of action, injuries, claims, negligence, costs or expenses, arising out of or related to my attendance at the Event and participation in any related activities.

Waiver of Liability:

Attendee voluntarily signs this waiver in favor of the Company in consideration for the Event opportunity. Having read this waiver and paid for a ticket in lieu of a signature to this waiver, Attendee acknowledges that for themselves, their heirs, executors, administrators, representatives, or anyone else who might claim on their behalf, do waive, release and discharge Company and its officers and directors, staff, employees, agents and volunteers from and against any blame and liability for any injury, harm, loss, inconvenience, or any other damage of any kind whatsoever, which may result from or be connected in any way to my participating in the Event, and agrees to hold them harmless from any such claim(s). In addition to the absolute and unqualified release from all liability, Attendee represents that they will conduct themselves in a safe and prudent manner while participating in the Event. Company reserves the right to cancel an activity or release a participant if we feel the participant’s conduct is inappropriate or disruptive. Attendee is aware that by agreeing this, Attendee is waiving certain legal rights, including the right to sue Company or its officers and directors, staff, employees, agents and volunteers for any claim that does not arise out of a claim related to or consisting of negligence.

Medical Treatment:

Attendee acknowledges that they are responsible for all medical expenses arising out of any injury, illness or medical emergency that they suffer or experience while attending the Event or engaging in any activities associated with the Event or recommended by the Event leaders, including transportation to or from any activities. In the event that they are unable to make medical decisions in an emergency, the Attendee gives permission to the physician selected by the Event leaders to secure and administer treatment, including hospitalization. In the event that Attendee is unable to make medical decisions in an emergency, Attendee gives permission to the Event leaders to contact emergency contacts listed on Attendee intake form.

Attendee agrees to hold Company and its officers and directors, staff, employees, agents and volunteers harmless for any medical decisions made on their behalf, for the actions of medical personnel taken on their behalf, and for any further injuries sustained while seeking medical treatment, including injuries associated with any transportation to medical facilities.

Media Release:

Any photographs or audio or video footage taken by Company or its officers and directors, staff, employees, agents and volunteers during the Event are the property of Company. Attendee grants permission for any photos, or audio or video footage taken by Company to be used for publication in any multi-media or advertising format, including brochures, websites, television, ads and publications, with the express purpose of marketing and promoting the Event or any of Company’s products or websites, or for any other lawful uses as may be determined by Company. Attendee further waives any and all rights to review or approve any uses of the images, any written copy or finished product.

Social Media Group Sharing Release:

Attendee grants permission for any photos, audio-visual footage, or interviews, both recorded and printed, to be shared on social media by Company representatives or by other event participants.

Liability Disclaimer of No Professional Advice: The information contained in or made available by Company, or any third-party through the Event or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. Company does not offer any professional personal, medical, financial or legal advice and none of the information contained in the Event should be confused as such advice.

Neither Company, nor their assigns, sponsors, speakers, partners, contractors or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Attendee or Attendee's business, including economic loss, that may result from participation in the Event or from the use of, or the inability to use, the materials, information, or strategies communicated through the Event or any products or services provided pursuant to the Event, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will Company be liable for any special or consequential damages that result from Attendee's participation in the Event.

To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions and results in life, and by your participation in our Event, you agree not to attempt to hold us, the Company, liable for any decisions, actions or results that you make or experience in business or in life due to your participation in this Event at any time, under any circumstance.

Confidentiality And Non-Compete:

Attendee hereby understands that the tools, processes, strategies, materials and information presented in the Event are confidential, copyrighted, and proprietary to Company and agrees not to record, duplicate, distribute, teach or train from the Event materials in any manner whatsoever without the express written permission of Company. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and Company will pursue legal action and full damages if these terms are violated in order to protect its rights.

Earnings Disclaimer:

Company has taken reasonable efforts to ensure Company accurately represents this Event and the Event’s potential to help Attendee to grow their business. Company makes no guarantee that Attendee will earn any money using the techniques discussed, displayed or exhibited herein. Nothing on this page or at this Event is a promise or guarantee of earnings. Attendee’s level of success in attaining similar results is dependent upon a number of factors including, but not limited to, their skill, knowledge, ability, dedication, business experience, and financial situation.

Because these factors differ according to individuals, Company cannot guarantee Attendee’s success, income level, or ability to earn revenue. Attendee, alone is responsible for their actions and results in life and business. Any implied or explicit statements, inferences or projections herein are simply Company’s expectations or forecasts for educational and entertainment purposes, and thus are not guarantees or promises for Attendee’s actual performance.

Speaker Disclaimer:

Company is not responsible for the behavior, actions or omissions of any speakers at the Event. The opinions and thoughts expressed by each speaker on-stage or off-stage are their own and are not shared by Company. Company cannot guarantee the performance or attendance of any named speakers, regardless of advertised lineup.

Covid-19 Guidelines For Live Event Experiences:

Company will monitor the ever-changing landscape of COVID-19 and the current guidelines for gathering to make reasonable efforts to care fo everyone’s health and safety stays top of mind and the recommended protocols are in place. The Walt Disney Resort will also be strictly adhering to every safety protocol, including but not limited to wearing masks (if required) in public spaces, social distancing where possible and sanitization stations throughout the property.

Company will make reasonable efforts to keep you updated on any advancements or changes made by the Walt Disney Resort as soon as reasonably possible. You as the Attendee can take some time to familiarize yourself with the updated Walt Disney Resort guidelines here: https://disneyworld.disney.go.com/experience-updates. Company offers as an alternative Virtual Experience of the Event available online, if at any time you as the Attendee do not feel comfortable attending in person.

However, there is no way to eliminate the inherent risk of exposure to COVID-19 that comes with an in-person event. By attending this Event, you as the Attendee voluntarily agrees to assume all risks related to exposure to COVID-19. You the Attendee agrees not to attend if you test positive for COVID-19 within 14 days prior to attending this Event, or if you as the Attendee display symptoms associated with COVID-19. Bottom line, please be forthcoming to keep us all safe and healthy.

Refund & Cancellation Policy:

All payments for Marketer's Heart Event are in USD and are non-refundable. This is a firm policy. Please purchase mindfully and honor the commitment you as the Attendee has made.

If you as the Attendee can no longer attend in-person, let Company know in writing as soon as possible and Company can add Attendee's ticket to the waitlist; and in the event that Company sells out of our 300 in-person tickets, Company can try to resell Attendee's ticket. If Company is able to resell Attendee's ticket, then Company will refund Attendee's full payment. After 12/01/2021, any waitlisted tickets left will be automatically transferred to a Virtual Ticket of Event, and Attendee will also get access to the recordings after Event.

Any ticket transfers (from Attendee to someone else) must be completed before January 28, 2022.

Dispute Resolution:

The laws of California govern all matters arising under or relating to this Agreement, including torts. Any controversy or claim arising out of or relating to this contract, or the breach of this Agreement, will be settled by alternative dispute resolution (ADR) prior to a formal complaint. ADR includes arbitration or mediation administered by an authorized entity, such as the American Arbitration Association, in accordance with its Commercial [or other] Arbitration Rules. Any judgment on the award rendered by the arbitrator(s) or mediator(s) may be entered in any court having jurisdiction over this Agreement and related dispute resolution proceedings.

Full Agreement and Understanding:

By purchasing a ticket to this Event, Attendee is of sound mind and at least 18 years of age (or the age of majority in Attendee’s jurisdiction). Attendee has read and fully understands these Terms, and the releases, disclaimers and disclosures contained herein.

This Agreement constitutes the final, exclusive agreement between Company and Attendee relating to the February 2022 Marketer’s Heart Event held in Orlando, Florida. All earlier or other negotiations and agreements between Company and Attendee on the matters contained in this Agreement are expressly merged into and superseded by this Agreement and any written amendments contained herein.

If any portion of this Agreement is found to be unenforceable and/or invalid, all other portions of this agreement will remain in full force and effect.

All headings are provided for convenience and should not be construed as part of this Agreement in the event of a discrepancy.

These Terms are subject to change at any time and at the sole discretion of the Company. Please visit the site regularly for updates.
